Frequently Asked Questions (FAQs)Q. What steps need to be followed to hire someone who is not a Canadian Citizen or permanent resident? A. Firstly, the position must be advertised in Canada. If there are no qualified Canadian citizens or permanent residents available, then a Labour Market Opinion (LMO) Application must be completed and approved from Human Resources Development and Skills Canada (HRDSC). This allows a successful candidate to apply to Citizenship and Immigration Canada (CIC) for a work permit, or for permanent resident status in Canada. The foreign worker must have a work permit or permanent resident status in Canada prior to commencing their job in Canada. Q. How long does it take to obtain a confirmation from Human Resources and Skills Development Canada (HRSDC)? A. Approximately 10 – 17 weeks Q. If an application requires Human Resources and Skills Development Canada (HRSDC) confirmation, when can the foreign worker apply for a work permit? A. Application for a work permit can be submitted to Citizenship and Immigration Canada as soon as the Labour Market Opinion and a system file number are received from Human Resources Development and Skills Canada. Q. When can travel arrangements be made? A. It is not advisable to make any travel arrangements until the foreign worker has received the Human Resources Development and Skills Canada system file number and received approval of their application for a work permit from Citizenship and Immigration Canada Q. What is an “open” work permit? A. An open work permit allows a foreign worker to work for any employer (ie. the permit is not employer-specific). Q. Are the workers you supply fluent in English? A. Depending on the needs of the employer, we will pre-screen candidates to ensure the desired level of English skills. We can also arrange for further ESL training in Canada Q. How long does it take for a foreign worker to arrive in Canada once we have signed a contract? A. The normal time frame is 6–9 months. There are several factors that can influence this timeline, but we will keep you informed of progress, or delays. Q. Who determines whether or not we are eligible to hire a foreign worker to meet our staffing needs? A. Human Resources and Skills Development Canada requires that a foreign worker application must be submitted by any business wishing to hire a foreign worker. They then evaluate your situation and deliver a Labour Market Opinion, which essentially approves or declines the application. Q. What is the NOC? What does it do? A. The NOC is the National Occupational Classification Matrix that was established in 2001 by Human Resources Development and Skills Canada. Its primary purpose is to assist employers in determining the skill level of a particular position and assigning it into a specific Group and Skill Level. This classification will determine the category of worker that you require and the rules and regulations that apply to hiring a foreign worker for that position. Q. Why should we consider hiring foreign workers? A. Hiring a foreign worker is quickly becoming the only viable option when Canadian companies are unable to meet their staffing needs with workers from the Canadian labour market. This can be due to a lack of skilled applicants, or more commonly, simply a lack of applicants. Foreign workers see an opportunity to gain a foothold in a highly desirable place to live (Canada). They are very motivated to succeed. Q. Why are we short of Canadian workers? Why are we having so much trouble finding workers? A. The landscape of the Canadian workplace is changing, and the economics of the oil and gas industry in Western Canada is fuelling the work shortage. Additionally, with the “baby boomers” making up a full third of the Canadian population, the average age of many professional and skilled workers is 50 years old or older. These workers are retiring faster than new workers are available to fill the positions. Q. Which country do you recruit most of your foreign workers from and why? A. We currently recruit most of our skilled workers from China and other Southeast Asian countries. This area is densely populated and contains the largest available labour pool in the world. Many candidates are well educated, travel and speak English and are very motivated to work in Canada. We are currently looking to expand our labour pool to other countries worldwide as appropriate. Q. How much will it cost and what assurance do we have that we will be happy with the workers you provide? A. We charge you $5,000.00 (plus return airfare) per unskilled worker, $5,000.00 per skilled worker and Professional worker successfully brought to Canada. We provide a ninety (90) day conditional guarantee for every worker that we place. Please ask for details. Q. Do you screen your applicants? A. Our overseas agents carefully prescreen qualified candidates for the job requirements that you set. They assist in work permit, visa application and criminal and health checks. Q. Many of my employees are nearing retirement age, other employees are quitting, are other businesses also affected? A. Yes, you are not alone. Canadians are retiring at a faster rate than new workers are available to replace them. Also birth rates in Canada have not produced enough workers. This trend is projected to become worse over time and critical within the next decade. Increasing the number of skilled immigrants coming to Canada is the only way to stabilize our work force. Q.
